NOTICE OF SUBSTITUTE TRUSTEE’S SALE
WHEREAS, on June 2, 2004, DONALD WAYNE RANDOLPH and wife, MARY RANDOLPH, executed a Deed of Trust to Robert A. Verble, Trustee for Citizens Bank of Carthage, for a certain indebtedness, which Deed of Trust was recorded in BK 1171, Page 987 in the Register’s Office for Cumberland County, Tennessee and modified October 8, 2017 as found recorded in BK 1303, page 1705 in the Register’s Office for Cumberland County, Tennessee; and
WHEREAS, default having been made in the payment of the indebtedness, I, WILLIAM D. MITCHELL, Substitute Trustee, by virtue of instrument recorded in the Register’s Office for Cumberland County, Tennessee, will sell the property on Friday, January 26, 2018 at 1:00 o’clock p.m. CDST, at the East Door of the Cumberland County Courthouse, Crossville, Tennessee to the highest and best bidder, for cash, as described in the Deed of Trust as follows:
Lying and being in the Eighth (8th) Civil District of Cumberland County, Tennessee and more particularly described as follows, to-wit:
Tract No. 3 of an unrecorded plat: Beginning on an iron pin, northeast corner of Tract 2; thence south 16 degrees 00 minutes west intersecting an iron pin at 1117.62 feet continuing south 16 degrees 00 minutes west a total distance of 1217.11 feet to the center of Caney Fork River; thence along said river south 56 degrees east 374 feet; thence north 16 degrees 00 minutes east, intersecting an iron pin at 84.16 feet, continuing north 16 degrees 00 minutes east a total distance of 1217.25 feet to an iron pin; thence north 55 degrees 49 minutes west 374.10 feet to the point of beginning, containing 9.9 acres. Also conveyed to the grantees, their heirs and assigns, is the right of egress and ingress to the roadway along the existing road now on the property. We hereby reserve the grantors, their heirs and assigns a roadway easement along the existing road now on the property. Road easement for roadway and utilities. Easement to be 30 feet in width plus an additional 15 feet on each side for utility easement.
Being the same property conveyed to Donald Wayne Randolph and wife, Mary E. Randolph, from Caney Fork Investors, Inc., A Tennessee corporation, by James E. Davis, president and Johnnie L. Reeves, Secretary/Treasurer to Donald W. Randolph N/A and Mary E. Randolph N/ A, dated 07/24/1991 recorded on 07/31/1991 in Book 419, page 197 in the Register’s Office for Cumberland County, Tennessee.
This property is located at 340 Wolfe Creek Drive, Crossville, Tennessee and is further identified by County Map 084, Parcel 012.13 in the Tax Assessor’s Office for Cumberland County, Tennessee.
Said sale will be bar of equity and right of redemption, homestead, dower and all other exemptions. The sale will also be made subject to the payment of all unpaid taxes. The proceeds derived from said sale will be applied to the payment of the costs and charges of the sale and the indebtedness set forth in the Deed of Trust.
The sale held pursuant to this Notice may be rescinded by the Substitute Trustee or adjourned the day of sale to another day, time, and place certain without further publication, upon announcement at the time and place for the sale set forth above.
