NOTICE
Pursuant to the Fourth Amendment to the Amended and Restated Declaration of Horizontal Property Regime and Master Deed of the Mariner’s Pointe Interval Owners Association, Inc., of record in Book 1500, Page 688, Register’s Office, Cumberland County, Tennessee, as voted and approved by its board of directors on the 19th day of April 2017, and the Second Amendment to the Amended and Restated Declaration of Horizontal Property Regime and Master Deed of the Mariner’s Pointe Interval Owners Association, Inc., of record in Book 1238, Page 961, Register’s Office, Cumberland County, Tennessee, and as voted and approved by its members and board of directors on the 29th day of April 2006, PLEASE TAKE NOTICE that on AUGUST 11, 2017, at 11:00 A.M. at the Main Street entrance of the Cumberland County Courthouse, 2 North Main Street in Crossville, Tennessee, the undersigned appointed Trustee, pursuant to the authority granted at Book 1270, Page 2274, Register’s Office, Cumberland County, Tennessee, will sell to the highest and best bidder pursuant to said Amendments as referenced above, the hereinafter described property. All recording references are to the Register’s Office of Cumberland County, Tennessee.
All property described in Exhibit “A” is timeshare property located at Mariner’s Pointe Resort, Crossville, Tennessee. The street address of this property is 109 Mariner’s Pointe Resort, Crossville, Tennessee, 38555, Map 99, Parcel 65.01. All property lies in the First Civil District of Cumberland County, Tennessee.
A description of the property to be sold, the source of title of the current owner, and lien date and amount is listed in Exhibit A. The following property lies in the First Civil District of Cumberland County, Tennessee, and is described below as being the Unit Week of Condominium Unit Number, Bedroom Type, Building Number. Only the timeshare unit weeks described will be sold.
The sale of this property will be subject to the Declaration of Horizontal Property Regime Master Deed and all Exhibits attached thereto, which is recorded in Register’s Office of Cumberland County, Tennessee, in Deed Book 239, Page 33, and the Amended and Restated Horizontal Declaration of Property Regime and Master Deed recorded in Deed Book 496, Page 150, the First Amendment to the Amended and Restated Horizontal Declaration of Property Regime and Master Deed recorded in Deed Book 1238 Page 858, the Second Amendment to the Amended and Restated Declaration of Horizontal Property Regime and Master Deed recorded in Deed Book 1238, Page 961, the Third Amendment to the Amended and Restated Declaration of Horizontal Property Regime and Master Deed recorded in Deed Book 1485, Page 1345, and the Fourth Amendment to the Amended and Restated Declaration of Horizontal Property Regime and Master Deed recorded at Book 1500, Page 688, Register’s Office Cumberland County, Tennessee.
The sale of each of the described timeshare unit weeks will be conducted separately and one at a time. The entire purchase price is due and payable at the conclusion of the sale in the form of a certified check. No personal checks will be accepted. To this end, you must bring sufficient funds to outbid the Association and any other bidders. Insufficient funds will not be accepted. Each sale will be in bar of all the equities and rights of redemption, statutory or otherwise, including the right of redemption provided for in Tennessee Code Annotated Section 66-8-101, et seq., homestead, marital interest and all other rights or exemptions of every kind, and without warranty as to title or encumbrances. Said sale shall be made subject to any and all restrictions, reservations, conditions and liens, and any unpaid real property taxes applicable to said property. The right is reserved to adjourn the day of the sale to another day, time, and place certain without further publication, upon announcement at the time and place for the sale set forth above. The Trustee reserves the right to rescind the sale, and is subject to confirmation by the Trustee.
